Individuals do not have a right to participate in clinical trials. But, they do have a right against being denied participation for inappropriate reasons. Despite the widespread endorsement of these two claims, there has been little discussion regarding which conditions for participation in clinical trials are appropriate and which are inappropriate. The present manuscript attempts to address this gap in the literature. We first describe and then argue against the claim that conditions on enrollment or continued participation are appropriate only (...) when they are needed to answer the scientific question(s) posed by the trial. We then offer an alternative view according to which the appropriateness of conditions depends on whether they help to satisfy the ethical requirements of clinical research. Because these requirements include social value, the present view implies that promoting social value is an acceptable reason to impose conditions on research participation. With this in mind, we explain why it is not coercive to require potential participants to accept conditions on enrollment that promote a trial's social value, even when the participants find those conditions unwelcome. We conclude by evaluating the present proposal's implications for the common practice of requiring participants to agree to the possible use of their leftover biospecimens in a broad range of future research. We argue, contra current regulatory policy, that this practice can be acceptable even when the present trial offers participants the prospect of clinical benefit and the samples are being reserved for future research that is unrelated to the present trial. When speaking of the philosophical importance of James’s late style, critics and philosophers have taken two broad approaches. One route, exemplified by Martha Nussbaum, attributes this style to the sensitivity of the characters. The other, exemplified by Robert Pippin, attributes the writing’s complexity to the ambiguities of the moral codes during this period of history. In my reading, James’s texts address a more general problem of modernity, which is the flattening of the lifeworld (Lebenswelt) by disengaged approaches to both (...) epistemology and morality, the reduction of the lifeworld to the environment (Umwelt). James’s works open an ontological dimension to the question of language and normativity, a question that modernity’s moral languages—whether based on deontology, utility, or virtue—fail to articulate. His texts interrogate what normativity is rather than just portraying the sensitivity of the characters or uncertainty of the historical moment, although both of those readings are certainly justified. Abstract: There has been an ongoing dispute between defenders of world disclosure (understood here in a loosely Heideggerian sense) and advocates of normative debate. I will take up a recent confrontation between Charles Taylor and Robert Brandom over this question as my point of departure for showing how world disclosure can expand the range of normative argument. I begin by distinguishing pre-reflective disclosure—the already interpreted, structured world in which we find ourselves—from reflective disclosure—the discrete intervention of a particular utterance (...) or text. I discuss Taylor’s notion of social imaginaries as a way of thematizing our pre-reflective background and Talal Asad’s critique of Taylor to show how this background can be one space of argument. I then develop my own understanding of reflective disclosure, of which Taylor gives an indequate account, developing my argument with help of literature, including a close analysis of Susan Glaspell short story “A Jury of Her Peers.” This story illustrates how world disclosure can make normative arguments without confining itself to Brandom’s or Habermas’s idea of the exchange of reasons. ONE OF THE MOST prominent theorists of anarcho-capitalism is Hans- Hermann Hoppe. In what is perhaps his most famous result, the argumentation ethic for libertarianism, he purports to establish an a priori defense of the justice of a social order based exclusively on pri- vate property. Hoppe claims that all participants in a debate must presuppose the libertarian principle that every person owns himself, since the principle underlies the very concept of argumentation. Some libertarians (e.g., Rothbard 1988) have celebrated Hoppe’s (...) argument as the final nail in the coffin for collectivism of any type; following Hoppe, they believe that to deny the libertarian ethic is not only wrong, but also internally contradictory. On the other hand, a number of other prominent libertarians characterized Hoppe’s initial statement of his case as “one muddle after another” (Steele 1988, p. 47) or “a tissue of bald assertions” (Yeager 1988, p. 45). In lieu of an abstract, here is a brief excerpt of the content:Objectivity and InterpretationRobert SteckerAccording to Gregory Currie, literary interpretation suffers from a failure of objectivity. 1 He does not claim that the failure is complete, that it is not an objective matter in the least degree which interpretations of a literary work are acceptable, but he does claim that the degree of objectivity is at best small.I believe that literary interpretation is capable of a high degree of objectivity (...) in the sense Currie specifies as well as in other senses. However, the same standard of objectivity is not properly applied to all interpretations, because there are many different aims or interests with which interpretations are advanced, and the requirements of objectivity on acceptability vary with aim.Currie’s argument for objectivity failure should not be accepted. The most important reason for this is that it is based on a faulty conception of the enterprise of literary interpretation. However, the argument is also questionable on that conception.IBefore examining Currie’s argument, it is best to be clear about the objectivity in question. Just what has, or lacks objectivity, and what makes it more or less objective? I confess to being less than completely clear about Currie’s answer to this question. Let us say that it is judgments that are or are not objective, leaving it open for now which literary judgments are in question in Currie’s claim about objectivity failure. Objectivity depends on the possibility of intersubjective agreement or “agreement across points of view” as Currie puts it. Judgments of taste (e.g., “sushi is delicious”) are common candidates for judgments [End Page 48] that are not objective. We can suppose judgments of leftness are objective because we can all agree with my judgment that the book is to my left even if it is to other people’s right and would be to my right were I to reorient myself. Of course, that we can (should?) all agree doesn’t mean we always will. For various reasons, not all of which are relevant to objectivity, some may refuse to agree.According to Currie, objectivity comes in degrees, and nothing said so far indicates how we assign a degree of objectivity to a judgment. Extent of agreement or probability of reaching agreement might be invoked here, but these are not what Currie has in mind. In Currie’s view, degree of objectivity depends on the degree to which a judgment needs to be relativized before it is capable of getting agreement. There is something intuitive in this, but it is tricky to spell out the relevant criterion. Suppose the sushi lovers of Osaka can pretty much agree among themselves about what is good sushi. So can the sushi lovers of Kyoto. However, they cannot agree with each other. What is good sushi is relative to different groups of sushi lovers and their different standards, and that seems to make the goodness of some sushi a less objective matter than if there were one overarching standard. On the other hand, judgments of leftness are also capable of receiving agreement only when relativized to an individual and her orientation. Yet that does not undermine their objectivity. Similarly, to use an example of Currie’s, judgments of velocity need to be made relative to a frame of reference if they are to receive agreement, but that does not undermine their objectivity. Hence relativizing does not always undermine objectivity. Perhaps the relevant difference is something like this. There is no such thing as leftness not relativized to individual and orientation. There is no such thing as velocity not relativized to frame of reference. But perhaps there is such a thing as being a good F not relativized to group standards. This may not be so with sushi, but perhaps it is with carving knives or with stainless steel. In that case judgments of goodness that are independent of group standards, and hence capable of receiving agreement across groups, are more objective than those that are not. However, if all judgments of goodness are by their nature relative to group standards, the above reasoning suggests that such judgments are just as objective as judgments about velocity. The Flats, a district near downtown Cleveland, was once was the vibrant heart of Midwestern industry and is now in the throes of change: Some of its warehouses and factories have been transformed into nightclubs and restaurants, while homes in adjacent neighborhoods have been replaced by mini-mansions. Through an analysis of key themes in Heidegger's work, the book challenges the traditional theological appropriation of Heidegger and the usual characterizations of religious thinking in terms of faith or belief in, or experience of, some ultimate reality. Heidegger, it is argued, offers a unique approach to a variety of issues and problems in contemporary religious thought and philosophy of religion that results in understanding religious thinking as a resolute openness to the holiness and meaningfulness of the world.

New research tools such as PET can produce dramatic results. But they can also produce dramatic artifacts. Why is PET to be trusted? We examine both the rationale that justifies interpreting PET as measuring brain activity and the strategies for interpreting PET results functionally. We show that functional ascriptions with PET make important assumptions and depend critically on relating PET results to those secured through other research techniques.

Over the course of his distinguished career, Edward Weinshel has been a moral and intellectual force in contemporary psychoanalysis and an outspoken opponent of current trends in and out of the field toward dehumanization and deindividualization. _Commitment and Compassion in Psychoanalysis_, under the editorship of Robert Wallerstein, brings together 14 of Weinshel's major papers. The six clinical papers reprinted in this collection address the kaleidoscope of common personality organizations and propensities which, in their extreme variants, motivate individuals to seek (...) psychoanalytic assistance, covering topics that include "neurotic equivalents" of necrophilia, negation, lying, "gaslighting", perceptual distortion during analysis, and inconsolability. The remaining four papers, published between 1984 and 1992, chronicle Weinshel's notion of resistence as the clinical unit of the psychoanalytic process, his elucidation of specifically "psychoanalytic change" as it grows out of the psychoanalytic process, and his affirmation of modern conflict theory in the face of theoretical pluralism. Carefully edited by Robert Wallerstein and including an introductory essay by Leonard Shengold, _Commitment and Compassion in Psychoanalysis_ brings to contemporary debates the voice of a principled exemplar of the psychoanalytic calling. Balancing intellectual acuity with a profoundly caring temperament, and augmenting respect for the psychoanalytic tradition with a flair for original ideas, Edward Weinshel speaks to all who wrestle daily with the burdens, challenges, and healing promise of the impossible profession. Numerous labor-management issues possess ethical dimensions and pose ethical questions. In this article, the authors discuss four labor-management issues that present important contemporary problems: union organizing, labor-management negotiations, employee involvement programs, and union obligations of fair representation. In the authors view, labor and management too often view their ethical obligations as beginning and ending at the law''s boundaries. Contemporary business realities suggest that cooperative and enlightened modes of interaction between labor and management seem appropriate.

Rawls offers three arguments for the priority of liberty in Theory, two of which share a common error: the belief that once we have shown the instrumental value of the basic liberties for some essential purpose (e.g., securing self-respect), we have automatically shown the reason for their lexical priority. The third argument, however, does not share this error and can be reconstructed along Kantian lines: beginning with the Kantian conception of autonomy endorsed by Rawls in section 40 of Theory, we (...) can explain our highest-order interest in rationality, justify the lexical priority of all basic liberties, and reinterpret Rawls’ threshold condition for the application of the priority of liberty. Perhaps unsurprisingly, this Kantian reconstruction will not work within the radically different framework of Political Liberalism. (shrink)

This study examines the relationship between corporate diversification strategy and the pollution activity of subsidiaries within the U.S. chemical industry using TRI data (EPA's Toxic Release Inventory). The subsidiaries of conglomerates were found to exhibit higher pollution levels for direct emissions than those of firms pursuing more related diversification strategies. Additionally, the subsidiaries of conglomerates exhibited more variance in overall pollution emissions compared to related diversified firms.

In the wake of both the semiotic and the psychoanalytic revolutions, how is it possible to describe the object of religious worship in realist terms? Semioticians argue that each object is known only insofar as it gives birth to a series of signs and interpretants (new signs). From the psychoanalytic side, religious beliefs are seen to belong to transference energies and projections that contaminate the religious object with all-too-human complexes. Mario Bunge is a philosopher of great repute, whose enormous output includes dozens of books in several languages, which will culminate with his Treatise on Basic Philosophy projected in seven volumes, four of which have already appeared [Reidel, I 974ff. ]. He is known for his works on research methods, the foundations of physics, biology, the social sciences, the diverse applications of mathematical methods and of systems analysis, (...) and more. Bunge stands for exact philosophy, classical liberal social philosophy, rationalism and enlightenment. He is brave, even relentless, in his attacks on subjectivism, mentalism, and spiritualism, as well as on positivism, mechanism, and dialectics. He believes in logic and clarity, in science and open-mindedness - not as the philosopher's equivalent to the poli tician's rhetoric of motherhood and apple pie, but as a matter of everyday practice, as qualities to cultivate daily in our pursuit of the life worth living. Bunge's philosophy often has the quality of Columbus's egg, and he is prone to come to swift and decisive conclusions on the basis of argu ments which seem to him valid; he will not be perturbed by the fact that most of the advanced thinkers in the field hold different views. Contemporary republicanism is characterized by three main ideas: free persons, who are not subject to the arbitrary power of others; free states, which try to protect their citizens from such power without exercising it themselves; and vigilant citizenship, as a means to limit states to their protective role. This book advances an economic model of such republicanism that is ideologically centre-left. It demands an exit-oriented state interventionism, one that would require an activist government to enhance competition and resource exit from (...) dominating relationships within markets of all types, be they marital, labour, or residential. The substantial intervention and redistribution necessitated by such an approach make it leftist, while its tendency to work with rather than against the grain of markets makes it centrist. It is, in short, a contribution to progressive republican political thought, but one that is less social-democratic than market-democratic in character. (shrink)

Many scholars, including G. A. Cohen, Daniel Attas, and George Brenkert, have denied that a Kantian defense of self-ownership is possible. Kant's ostensible hostility to self-ownership can be resolved, however, upon reexamination of the Groundwork and the Metaphysics of Morals. Moreover, two novel Kantian defenses of self-ownership (narrowly construed) can be devised. The first shows that maxims of exploitation and paternalism that violate self-ownership cannot be universalized, as this leads to contradictions in conception. The second shows that physical coercion against (...) rational agents involves a profound status wrong--namely, their treatment as children or animals--and that this system of differential status and treatment (including self-ownership rights for rational agents) can be morally justified by our capacity for autonomy. "Whole brain death" (neurological death) is well-established as a legal standard of death across the country. Recently, New Jersey became the first state to enact a statute recognizing a personal religious exemption (a conscience clause) protecting the rights of those who object to neurological death. The Act also mandates adoption through the regulatory process of uniform and up-to-date clinical criteria for determining neurological death.

This volume contains the English translation of Felix Kaufmann's (1895-1945) main work Methodenlehre der Sozialwissenschaften (1936). In this book, Kaufmann develops a general theory of knowledge of the social sciences in his role as a cross-border commuter between Husserl's phenomenology, Kelsen's pure theory of law and the logical positivism of the Vienna Circle. This multilayered inquiry connects the value-oriented reflections of a general philosophy of science with the specificity of the methods and theories of the social sciences, as opposed to (...) abstract natural science and psychology. The core focus of the study is the attempt to elucidate how and under what conditions scientific knowledge about social facts, empirically justified and theoretically embedded, can be obtained. The empirical basis of knowledge within the social sciences forms a phenomenological concept of experience. According to Kaufmann, this concept of experience exhibits a complex structure. Within the meaning-interpretation of human action as the core of knowledge in the social sciences, this structure reaches out across the isolated act of verification toward the synthesis of external and internal experiences. The book opens with a detailed and useful introduction by Ingeborg K. Helling, which introduces the historical and theoretical background of Kaufmann's study and specifically illuminates his relation to Alfred Schütz and John Dewey. Corrington situates the divide between "nature naturing" and "nature natured" within the contest of classical American pragmaticism and postmodern psychoanalysis. At the heart of this new metaphysics is an insistence that all signs participate in larger orders of meaning that are natural and religious. Jeremy Waldron has recently raised the question of whether there is anything approximating the creative self-authorship of personal autonomy in the writings of Immanuel Kant. After considering the possibility that Kantian prudential reasoning might serve as a conception of personal autonomy, I argue that the elements of a more suitable conception can be found in Kant’s Tugendlehre, or “Doctrine of Virtue”—specifically, in the imperfect duties of self-perfection and the practical love of others. This discovery is important for at least three (...) reasons: first, it elucidates the relationship among the various conceptions of autonomy employed by personal-autonomy theorists and contemporary Kantians; second, it brings to the surface previously unnoticed or undernoticed features of Kant’s moral theory; and third, it provides an essential line of defense against certain critiques of contemporary Kantian theories, especially that of John Rawls. Historically, republicans were of different minds about markets: some, such as Rousseau, reviled them, while others, like Adam Smith, praised them. The recent republican resurgence has revived this issue. Classical liberals such as Gerald Gaus contend that neo-republicanism is inherently hostile to markets, while neo-republicans like Richard Dagger and Philip Pettit reject this characterization—though with less enthusiasm than one might expect. I argue here that the right republican attitude toward competitive markets is celebratory rather than acquiescent and that republicanism demands (...) such markets for the same reason it requires the rule of law: because both are essential institutions for protecting individuals from arbitrary interference. I reveal how competition restrains—and in the limit, even eradicates—market power and thereby helps us realize “market freedom,” i.e., freedom as non-domination in the context of economic exchange. Finally, I show that such freedom necessitates “Anglo-Nordic” economic policies. (shrink)

The various cosmological proposals by Einsteinian relativists seek to show the structure of the world as a consequence of the basic notions of relativity. In particular, the irrelevance of the state of motion of an observer to his description of the fundamental laws of nature is to be maintained. Furthermore, gravity is understood as being a description of the fact that particles move along certain minimal paths in non-Euclidean space. In this theory, the effect of one material particle on another (...) particle in the old-fashioned sense of gravitational attraction becomes indirect; that is, a particle moves on a minimal path in a space having a degree of curvature dependent on the material entities which exist in it, rather than having its path bent by the attraction between it and other material bodies, all of them existing in an absolute or receptacle-like space. Is “liberal socialism” an oxymoron? Not quite, but I will demonstrate here that it is a much more unstable and uncommon hybrid than scholars had previously thought and that almost all liberals should reject socialism, even in its most attractive form. More specifically, I will show that three leading varieties of liberalism—neutralist, plural-perfectionist, and deliberative-democratic—are incompatible with even a moderate form of socialism, viz., associational market socialism. My paper will also cast grave doubt on Rawls’s belief that justice as fairness (...) is consistent with liberal socialism. (shrink)
